Terms of Service

NOTICE

These Terms of Service are a legal document between you, the end user, and File Qube. We strongly recommend that you read it carefully before using the Service.

Definitions:

(a) "File Qube": the File Qube Company and this website, with the exception of its shareholders and operators.

(b) "File": any document uploaded to File Qube server or hosted on the server.

(c) "User": the individual who uploads files to File Qube and uses File Qube server for file temporary storage.

(d) "Link": the location of any file stored File Qube server.

By using the File Qube Service, you are agreeing to become bound by these Terms of Service. You acknowledge and agree that File Qube may revise these Terms of Service from time to time. By continuing to use the File Qube Service after File Qube revises these Terms of Services, you agree to be bound by the revised Terms of Service.

Description of Services

The File Qube Service provides a user the ability to upload a file to File Qube server, to send a file link to one or more recipients, and to host a file on File Qube server during 30 days (during 45 days, provided that a user enters his valid email address). The recipient(s) of a file link can access and download a file by clicking on the link.

General Prohibitions

File Qube reserves the right to remove or replace any uploaded files, and assumes no liability for lost registration links or misplaced file links. Uploading any type of the below-mentioned files will result in the immediate termination of user’s ability to use the File Qube Service.

You agree to NOT use the File Qube Service to upload and host:

• Files that infringe on the copyrights of any entity. This includes, but is not limited to, copyrighted photographs, as well as files for which user lacks usage and distribution permissions
• Any data, text, graphics, content, or material that is false or misleading
• Files that are defamatory, obscene, pornographic, or offensive
• Files whose intended use or purpose is to harass individual or multiple persons
• Files that promote bigotry, racism, or harm against any individual or group
• Files that invade another’s privacy or infringe another’s rights, including any intellectual property rights
• Files that violate, or encourage any conduct that would violate, any applicable law or regulation or would give rise to civil liability

Acceptable Use

File Qube reserves the right to immediately suspend or terminate any transmission that violates this policy, without prior notice. As a condition to your use of the File Qube Service, you agree not to:

• Access, tamper with, or use any non-public areas of the Service or File Qube computer systems or the technical delivery systems of File Qube providers
• Attempt to probe, scan or test the vulnerability of a system or to breach security or authentication measures without express authorization of File Qube
• Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Service
• Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Service
• Use of any device, software, or routine to interfere with the proper working of the Service
• Impersonate or misrepresent your affiliation with any person or entity
• Take any action that imposes an unreasonable or disproportionately large load on the File Qube infrastructure

File Qube reserves the right to determine what is harmful to its users, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the Service or the Internet.

Be informed File Qube reserves the right to investigate and prosecute violations of any of the above, including intellectual property rights infringement and security-related issues, to the fullest extent of the law. File Qube may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms of Service.

Copyright Policy

The File Qube Service may be used only for lawful purposes. By using the Service, you represent and warrant that you are the author and copyright owner and/or proper licensee with respect to any hosted content and you further represent and warrant that no content violates the trademark or rights of any third party. File Qube reserves the right to suspend or terminate a user’s transmission(s) that, in File Qube’s discretion, violates these policies or violates any law or regulation.

Responsibility for Data

By using the File Qube Services, you agree that you have sole responsibility for all files that you store on File Qube server. You acknowledge and agree that File Qube will not be responsible for any failure of the Service to store a file, for the deletion of a file stored on the Service, or for the corruption of or loss or any data, information or content contained in a file.

Proprietary Rights

You acknowledge that all materials (except those uploaded by users) provided on this web site, including but not limited to information, documents, products, logos, graphics, sounds, gui, software, and services are provided either by File Qube or by their respective third party authors, developers and vendors and the underlying intellectual property rights are owned by File Qube and/or its Third Party Providers. File Qube, its logo and other File Qube’s products referenced herein are trademarks of File Qube, and may be registered in certain jurisdictions.

Limitation of Liability

Your use of File Qube is at your own risk. If you are dissatisfied with any aspect of our Service or with these Terms of Service, or any other rules or policies, your sole remedy is to discontinue use of the Service. You expressly understand and agree that File Qube shall not be liable for any direct, indirect, incidental, special, consequential exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages).

Applicable Law

These Terms of Service shall be interpreted in accordance with the laws of the State of California . You agree and consent that jurisdiction and proper venue for all claims, actions and proceedings of any kind relating to the File Qube Service shall be exclusively in a federal or state court in San Diego County , California .

Illegal files will be removed immediately after notice. File Qube will add them to its file-filter, so they can’t be uploaded again.
